The Waitakere District Plan was made operative on 27 March 2003. Proposed
and Operative Plan Changes to the District Plan are listed below.

may have altered because of Councils decisions on submissions.
Proposed Plan Change 41 - Heritage Vegetation
To schedule 240 heritage vegetation items
Explanation
Proposed Plan Change 41 seeks to schedule a further 240 heritage vegetation items containing significant trees/groups of trees under the Heritage Appendix of the Auckland Council District Plan (Waitakere Section) (the District Plan). This will give these items the level of protection afforded by
Rule 3 of the District Plan’s Heritage Rules
(Size 827K):
Appendix D of the District Plan's Policy Section sets out the criteria for including significant trees/groups of trees in the Heritage Appendix:
"…trees will be included on the Heritage Appendix if they are nominated by the community or the Council and meet a threshold of 125 using the Royal New Zealand Institute of Horticulture (RNZIH) Standard Tree Evaluation Method (STEM), as modified by the Council as a method of assessing arboricultural (scientific), amenity, and notable criteria."
The following heritage vegetation items (in alphabetical order) are to be added to the District Plan's Heritage Appendix as they passed the threshold of 125 after being assessed by Auckland Council arborists using Standard Tree Evaluation Methodology (STEM):

Note: The list provides further details for each heritage vegetation item (in
alphabetical order) and includes aerial and site photos of the tree(s)/groups of trees, and the relevant STEM evaluation produced by Auckland Council arborists.
There will be consequential changes to the
District Plan’s Human Environment Maps, with the location of all proposed heritage vegetation items being depicted on the maps by an orange tree icon and its associated District Plan reference number in the
Heritage Appendix list which is proposed for inclusion in the District Plan.

Proposed Plan Change 40 - Pakinui Structure
Plan
Explanation
The Auckland Council has accepted an application for Proposed Private
Plan Change 40 – Pakinui Structure Plan, to the Waitakere City Operative
District Plan.
The Proposed Private Plan Change applies to 34 properties bounded by
Amreins Road, McEntee Road, Sunnyvale Road and northern territorial boundary
of the former Waitakere City Council.
The Proposed Private Plan Change seeks to insert a structure plan into
the District Plan and amend the District Plan Foothills Subdivision Rules
by allowing for further subdivision potential on the identified lots. The
effect of the Proposed Private Plan Change would be to allow a maximum of
65 additional lots to be established, subject to controls on streamside
enhancement, riparian planting, bush protection measures and stormwater
management. Subdivision beyond the amount allocated by the structure plan
would be a prohibited activity.

Titirangi Village and Variation 1 to Plan Change 17 (New Lynn)
Explanation
Proposed Plan Change 37 removes inappropriate District Plan provisions
relating to Titirangi Village, and proposes new policy guidance and matters
of assessment that seeks to provide long-term certainty for the desired
future character and amenity of Titirangi Village.
Plan Changes 35, 36 and 37 are considered necessary to achieve the purpose
of the RMA and the Waitakere Ranges Heritage Area Act 2008 (WRHAA) which
is to promote the sustainable management of natural and physical resources
and to protect, restore and enhance the heritage features of the Heritage
Area. The proposed Plan Changes are considered to be the most effective
and efficient means of fulfilling the Council's function under section 31
of the RMA and are consistent with the requirements of the WRHAA.
The Process
Plan Change 37 was publicly notified on Wednesday 10 February
2010. Submissions closed on
Friday 12 March 2010. A total of 108 primary submissions were
received.
A summary of decisions sought in submissions was publicly notified on
Wednesday 28 April 2010. The further submissions period was also
notified on this date.
Further submissions closed on Friday 4 June
2010. A total of 7 further submissions were received that support or
oppose primary submissions on plan change 37.
Hearing of submissions were held on 19 and 20 August 2010.

Rural Activities and Social, Cultural and Economic Wellbeing of the
People and Communities in the Waitakere Ranges Heritage Area

Proposed Plan Change 36 proposes to improve regulatory provisions within
the Waitakere Ranges Heritage Area associated with rural activities, the
enabling of future uses of rural land to retain a rural character, and to
provide for the social, cultural and economic wellbeing of the people and
communities in the Waitakere Ranges Heritage Area. It amends rules for the
Foothills, Coastal Village, Bush Living and Waitakere Ranges Environments.
Plan Changes 35, 36 and 37 are considered necessary to achieve the purpose
of the RMA and the Waitakere Ranges Heritage Area Act 2008 (WRHAA) which
is to promote the sustainable management of natural and physical resources
and to protect, restore and enhance the heritage features of the Heritage
Area. The proposed Plan Changes are considered to be the most effective
and efficient means of fulfilling the Council's function under section 31
of the RMA and are consistent with the requirements of the WRHAA.

Waitakere Ranges Heritage Area District Plan Section, Oratia Local Area
Plan, Waiatarua Local Area Plan and Oratia Rural Village
Explanation
Proposed Plan Change 35 proposes to establish a new Policy Section 5B,
entitled Waitakere Ranges Heritage Area. This will be an addition to the
current issues, objectives and policies of the Waitakere City District Plan.
It will also incorporate those elements of the Oratia and Waiatarua Local
Area Plans that relate to the Resource Management Act 1991 into the District
Plan.
Plan Changes 35, 36 and 37 are considered necessary to achieve the purpose
of the RMA and the Waitakere Ranges Heritage Area Act 2008 (WRHAA) which
is to promote the sustainable management of natural and physical resources
and to protect, restore and enhance the heritage features of the Heritage
Area. The proposed Plan Changes are considered to be the most effective
and efficient means of fulfilling the Council's function under section 31
of the RMA and are consistent with the requirements of the WRHAA.

Proposed Plan Change 34
Re-identification of Part of Royal Reserve - 5 Beauchamp Drive, Massey
Explanation
The proposed Plan Change relates to the re-identification of part of
Royal Reserve at 5 Beauchamp Drive, Massey. The Plan Change seeks to reidentify
approximately 1.8 hectares of land in the southern part of Royal Reserve
from Open Space Environment to Living Environment. It is proposed that the
Council exchange this land for a more useable area of land which is equivalent
in size, adjacent to the eastern boundary of Royal Reserve. The land to
be acquired through the exchange will form part of an improved and upgraded
Royal Reserve including improved sports field facilities, a new children's
playground and public walkways. In addition a new through road will be created
connecting Westgate Drive with Beauchamp Drive.

Proposed Plan Change No 32
Penihana North
The Auckland Council has resolved to advertise Proposed Plan Change 32 to the Waitakere City District Plan.
The Proposed Plan Change:
- defines the extent of the expansion of the urban part of Swanson;
- outlines (on an urban concept plan) the pattern for houses, streets, parks, storm water ponds and pedestrian linkages;
- protects and enhances native bush and the stream within the site;
- includes new rules to provide for a range of lot sizes and house types, with medium density housing located within walking distance of the train station and larger residential lots on the periphery of the land;
- limits the height of houses to a maximum of two storeys;
- provides for a resource consent process to consider subdivision and development;
- includes new design criteria to control the quality and design of subdivision, streets and parks;
- responds to adjoining rural character by including new design criteria and seeking larger lot sizes and setbacks for development next to Christian Road and the rural foothills; and
- includes design criteria to improve the quality of medium density housing.

Proposed Plan Change 25
Corban Estate Special Area
Explanation
The Proposed Plan Change seeks to provide an updated policy and rule
framework to manage the development of the Corban Estate as an arts and
culture centre within Waitakere City.
The Proposed Plan Change includes:
- Amendments to the existing Special Area Definition of the Corban
Estate Special Area, to include educational facilities, residential
activity (medium density housing and/or apartment dwellings) retail
services, and car parking;
- Amendments to the existing Special Area Rule 5 to enable educational
facilities, residential activity (medium density housing and/or apartment
dwellings, retail services, and car parking;
- Consequential amendments to the other District Plan Rules that apply
to development within the Special Area; and
- A correction of the title of the Special Area, replacing "Corbans
Estate" with "Corban Estate".
There are no changes to the District Plan Objectives and Policies, nor
to the District Plan Natural Area Rules that apply to the land within the
Corban Estate Special Area, and no changes to the District Plan Maps.
The Process

Proposed Plan Change 22
Explanation
The City has a clear policy position on Whenuapai which it has been pursuing
for a number of years. The Council has decided to initiate a District Plan
Change to protect the air base's potential as an airport.
The District Plan includes a number of
Special Areas, which provide an appropriate
planning framework for unique resources. The
Whenuapai Airbase represents
a substantial and unique resource in a strategic location. Council considers
it appropriate to incorporate a Policy and Rule framework into the District
Plan to enable the future use of the Airbase as an airport. There is already
an operative "Whenuapai Special Area” in the District Plan which relates
to a timber processing facility on Airport Road. Therefore the Special Area
for the airport is entitled the "Whenuapai Airport Special Area” to distinguish
it from the "Whenuapai Special Area”.
On 20 December 2006 the Council publicly notified a proposed change to
its District Plan " Plan Change 22 " to enable the Whenuapai airbase to
be developed in the future as a commercial airport. The Council believes
that, as a commercial airport, the airbase will generate significant economic
growth and investment in the north west of the Auckland Region.
The proposed change to the District Plan would create a Whenuapai Airport
Special Area, with policies and rules that mean the land can be developed
only for an airport and associated businesses.
Submissions on the proposed Plan Change closed at 5 pm on Wednesday 7
March 2007.
The period for further submissions closed on 1 June 2007.
The Plan Change was withdrawn on 1 December 2009.

The Local Government (Auckland) Amendment Act 2004 (LG(A)AA 2004) seeks
to integrate land use and transportation, especially in relation to intensification
and key transportation initiatives.
The legislation also requires all councils in the Auckland region to alter
their strategic planning documents to ensure that they are aligned with
the Auckland Regional Growth Strategy. These changes must be undertaken
in order to secure the additional Central Government funding of $1.6 billion
towards major infrastructure projects for the region. The LG(A)AA 2004 stipulates
that the changes required to the various planning documents must be publicly
notified no later than 31 March 2005.
Council has initiated a 'Growth and Transportation Integration Programme'
in response to the LG(A)AA 2004. The programme has a number of elements,
and in particular signals the Council's intention to:
- Manage and direct urban growth and rural development in an integrated
manner;
- Progress the intensification of the City around the major town centres
and address concerns around urban design outcomes through a series of
plan changes to the Waitakere City District Plan;
- Address specific issues of intensification, urban amenity and management
of the redevelopment of the New Lynn Town Centre through a specific
plan change to the Waitakere City District Plan;
- Seek an expansion of the Metropolitan Urban Limits (MUL) at Hobsonville
Airbase, Hobsonville Village and Massey North to allow for, in particular,
the development of additional employment land to meet the needs of the
growing community not able to be met in the existing urban area;
- Ensure district plan objectives, policies and rules supports and
better integrate intensified land use to support viable public transport
and investment in transport infrastructure; and
- Introduce Plan Changes to the Waitakere City District Plan in relation
to the Hobsonville Airbase, Hobsonville Village, Massey North and New
Lynn, to ensure that high quality, integrated and compact development
is undertaken in these growth areas in a manner that is consistent with
the City's overall Growth Management Strategy.

Appellants and Appeal

To assist the Environmental Court, the Council has prepared tables that
group points of appeal into topics. These tables seek to ensure that all
appeals on each topic are addressed in a coherent manner.
A letter that has been sent to all appellants and parties to the appeals
providing information about the grouped points of appeal. Responses received
from appellants have been corrected, and are now identified in the Version
2 and 3 Groupings provided below.
The Council has retained almost all points of appeal within the relevant
Plan Change Group. The exceptions to this occur where points of appeal directly
relate to a different Plan Change.
The Council has also combined with the Auckland Regional Council and
the other territorial local authorities in the Auckland Region to group
similar appeals by the National Trading Company in New Zealand, Progressive
Enterprises, The Warehouse, Warehouse Stationary Limited and Westfield New
Zealand Limited. These points of appeal relate to the location
of large format retail stores, and whether they are located in town centres,
transport corridors, or in both. These points of appeal form

Hearings and Decisions Information
Submissions on Plan Changes 13 to 18 have been heard by a Joint Panel
of Commissioners constituted under the LG(A)AA 2004.
After receiving the Joint Panel's recommendations, the Council released
decisions on submissions on 31 July 2007.
The Council has adopted the Joint Panel's recommendations on submissions
in their entirety. Consequently the Joint Panel's recommendation reports
have been adopted as the Council's decision reports.

This Proposed Plan Change seeks to:
- Rezone land that is currently occupied by the Hobsonville Airbase
from ‘Countryside Environment™ into four separate ‘Special Areas™ "
the ‘Hobsonville Base Village Special Area™, ‘Hobsonville Marine Industry
Special Area™, ‘Hobsonville Landing Special Area™ and ‘Hobsonville Future
Urban Special Area™ - each with its own set of specific rules and supporting
policies to manage development;
- Establish a number of ‘precincts™ within the Special Areas, to reflect
the particular character, constraints and opportunities that exist in
different parts of the Airbase;
- Introduce a ‘Hobsonville Airbase Concept Plan™ to guide development
across all of the Special Areas, and identify features that should be
retained and enhanced as development occurs;
- Establish a relatively prescriptive regime, with the introduction
of specific rules for each precinct to control the location and mix
of activities, the built form and design quality of development, and
to set the required minimum density of development;
- Control the sequencing of development, so that significant development
can initially occur only in the Hobsonville Marine Industry Special
Area and the Hobsonville Base Village Special Area;
- Limit comprehensive development in the Hobsonville Landing Special
Area and the Hobsonville Future Development Special Area until such
time as a further Plan Change process has occurred; and
- Create new riparian margins natural areas.

Massey North
This Plan Change seeks to:
- Rezone land at Massey North from ‘Countryside Environment™ and ‘Community
Environment™ to ‘Massey North Town Centre Special Area™ and ‘Massey
North Employment Special Area™, each with its own set of specific rules
and supporting policies to manage development;
- Provide for the establishment of industrial activities within the
Massey North Employment Special Area, and provide for a mix of commercial
and residential activities within the Massey North Town Centre Special
Area;
- Establish a number of ‘precincts™ within the Special Areas, to reflect
the particular character, constraints and opportunities that exist in
different parts of the land;
- Introduce a ‘Massey North Concept Plan™ to guide development across
all of the Special Areas, and identify features that should be retained
and enhanced as development occurs;
- Establish a relatively prescriptive regime, with the introduction

Proposed Plan Change 16
Managing City Growth
This Proposed Plan Change seeks to:
- Introduce a new chapter in the Policy Section of the District Plan,
to provide the strategic basis for the various Plan Changes proposed
in this package, and to include new objectives and policies concerned
with the management of growth;
- Set the platform to introduce future Plan Changes to implement the
Waitakere City Growth Management Strategy, which proposes that 77% of
the City™s growth will be accommodated within the existing urban area,
17% in the NorSGA corridor, and 6% in the rural area;
- Outline the key growth issues facing the City, noting in particular
that population is expanding faster than estimated rates, that there
is limited land area to provide for growth, that there is a potential
shortage of employment land, that the City has achieved only sporadic
success at urban intensification in town centres, and that there is
increasing pressure on the Waitakere Ranges and Foothills;
- Introduce a new objective, being "to manage growth in such a way
that will ensure the city develops and redevelops to achieve a compact
urban form - well integrated, with high amenity values and providing
appropriately for additional population, employment, community and business
services, by managing the location, density, scale, form, character,
timing and sequencing of urban and rural growth”;
- Establish eleven new policies focusing on the integrated management
of urban and rural growth, transport and associated design issues; and
- Create two new Policy Maps and a schedule outlining location and
staging of future urban growth in the city (as per the Waitakere City
Growth Management Strategy).

Proposed Plan Change 17
New Lynn
This Proposed Plan Change seeks to:
- Introduce specific rules and supporting policies intended to facilitate
and encourage the intensification of development in and around the New
Lynn town centre;
- Establish new Living 5 and Living 6 Environments to provide for
intensive residential development in selected locations around the New
Lynn town centre;
- Rezone land from Working Environment and Community (Periphery) Environment
to Community Environment, to provide for an expanded retail and mixed
use core town centre;
- Introduce a ‘New Lynn Concept Plan™ to guide development in and
around the New Lynn town centre, and identify features that should be
retained and enhanced as development occurs; and
- Create a ‘Monier Brick Making Special Area™ to protect the established
brick making industry from reverse sensitivity issues and provide for
its continued operation.
The proposed changes are intended to give a clearer framework within
which the further development and redevelopment of New Lynn as a mixed use
town centre can occur.
To accommodate the further growth of the retail and commercial area of the
centre an expanded Community Environment is proposed. The current distinction
in the District Plan relating to the Community and Community (Periphery)
is removed, and the new combined Community Environment is extended to apply
to land in the Clark Street area. Changes to the Community Environment rules
include:
- A new street frontages rule is introduced to manage the public /
private interface of development. Streets in the Community Environment
are classified as to the type of building form (set back, height, location
of parking) required to ensure that the Centre develops as a high quality,
community node.
- Car parking rules in the Community Environment are altered to provide
flexibility for residential development, and the redevelopment of small
sites. Car parking requirements for other development are reduced in
recognition of the current stock of parking in the centre, as well as
the availability of other travel modes.
Development over 20m in height requires assessment of visual and wind
effects.
A Concept Plan is introduced. This Concept Plan shows proposed new street
connections, as well as highlighting a number of features that need to be
taken into account in development proposals.
Residential development is made a non-complying activity in the Working
Environment in New Lynn.

Plan Change 12
Open Space Environment Provisions
Plan Change 12 relates to all land identified as Open Space Environment
that is located in Waitakere City. The parks and reserves in the City are
publicly owned land identified as Open Space Environment in the District
Plan. The Plan Change amends the provisions relating to the rules of the
Open Space Environment and the Natural Areas to better facilitate development
and general maintenance within parks and reserves.
The Plan Change introduced new definitions for activities and development
that are typically established on parks and reserves. The rules in the Open
Space Environment control and manage the effects of these park activities
and development on the land and neighbourhood adjoining parks and reserves.
The rules for the Natural Areas will continue to be used to manage any effects
on the natural environment from the activities and development that is proposed
in parks and reserves.
Reserve Management Plans
will be used as one of the references for assessing all proposals which
require resource consent under both the rules of the Open Space Environment
and the Natural Areas.
The Plan Change includes new policies which address the purpose of public
open space, and the requirement for public open space to balance the needs
of the city™s residents for recreational opportunities with protection of
the natural environment.
There is a consequential change to a Transport Environment rule relating
to signs outside a park or reserve.
There are some consequential changes to the procedural guideline for the
rules requiring the landowners written approval for developments on parks
and amending leases, if applicable; and changes in the ‘Introduction to
the Rules Section™ that relate to written consents and notification, for
resource consents in the Open Space Environment.

Birdwood Urban Concept Plan

The Concept Plan provides for an appropriate level and nature of development
in view of identified environmental constraints. Key features of the concept
plan include:
