I hereby give notice under section 65 of the Local Electoral Act 2001 that

There being more candidates than there are vacancies to be filled, a
By-election will be held between the listed candidates, under the First Past the
Post electoral system by postal vote, conducted over the period commencing 9am
on Monday 16 February 2009 and closing at 12 noon on Wednesday 11 March 2009.
Voting Period
Voting documents will be sent out to all qualified electors between
Monday 16 February 2009 and Saturday 21 February 2009.
All returned voting documents must be received by the Electoral Officer no
later than 12 noon on Wednesday 11 March 2009
Early Processing of Returned Voting Documents and Order of
Candidates' Names
Waitakere City Council has resolved pursuant to section 79 of the Local
Electoral Act 2001 that the returned voting documents will be processed
progressively on return, throughout the three week voting period. Waitakere City
Council has also resolved that the candidates’ names will be listed on the
voting documents in random order of surname.
Special Voting Facilities
Special voting facilities will be available during the period Monday 16th
February to Wednesday 11th March 2009 (both dates inclusive) from the Civic
Centre, Waitakere Central, 6 Henderson Valley Rd, Henderson, Waitakere, between
the hours of 8.30am and 4.30pm Monday to Friday. Special voting closes at 12
noon on Wednesday 11th March 2009.
Special votes may be claimed by:
- Electors who have lost, spoilt or destroyed their ordinary voting documents
which they have received in the post.
- Persons who are enrolled but who have not received their ordinary voting
documents in the post.
- Persons who have applied to be enrolled after the preparation of the final
electoral roll.

Background
Michael Neeson submitted his resignation from the position of Massey Community
Board Member, for personal reasons, to the Chief Executive Officer on Wednesday,
10 December 2008. The Chief Executive Officer subsequently notified the
Electoral Officer of the resignation on Wednesday, 10 December 2008.
Section 4 (2) of Schedule 7 of the Local Government Act 2002, provides that
resignations take effect from the day they are delivered to the Chief Executive
Officer, so Michael Neeson's resignation as a Member of the Massey Community
Board was effective from Wednesday, 10 December 2008.
Section 117 (1) of the Local Electoral Act 2001 prescribes that where a vacancy
occurs in the office of an elected member of a community board more than 12
months before the next triennial local authority election, the vacancy must be
filled by an election under that Act.
The resignation has created an extraordinary vacancy on the
Massey Community Board. The extraordinary vacancy must be dealt with as required by sections 117
to 120 of the Local Electoral Act 2002. Section 138A (1)(b) of that Act provides
that where the Electoral Officer receives notice of the resignation in the
period beginning 21 November and before 15 December the polling day must not be
earlier than 7 March in the following year.

Voting system for 2009
Councils were offered the choice of two voting systems for the 2007 Triennial
Elections. One system is the traditional First-Past-the-Post (FPP) system under
which electors vote for one person per seat and the candidate with the most
votes wins. The alternative is the Single Transferable Vote (STV) system, a
complex system under which electors rank all the candidates, with their
favourite at the top of their list and their least favourite at the bottom of
the list.
On 31 August 2005, the Waitakere City Council resolved to stay with the
First-Past-The-Post (FPP) electoral system. Residents were advised in a public
notice of this decision and of their right to demand a poll to change the
decision.
No demand from electors for a poll was received by the deadline and therefore,
the Waitakere City Council used the First-Past-the-Post (FPP) system in the
2007
Triennial Elections. Accordingly First-Past-the-Post will be the system used for
the Massey Ward By-Election to be held on Wednesday, 11 March 2009.
The Council has indicated that it will change the system of election to the
Single Transferable Vote method but that will not take effect until the
Triennial Elections in 2010.

Electoral RollsAll residential electors and non-resident ratepayer electors whose names appear
on the Massey electoral roll are eligible to vote in the By-election. The
preliminary electoral roll will be available for public inspection at the
Council's Electoral Office, Waitakere City Libraries (in the Massey Ward) and NZ
Post shops within the Massey Ward, from Tuesday, 23 December 2008 to Tuesday, 20
January 2009.
Copies of the roll will also be available for purchase at this time. Copies of
the 2007 Master (marked) rolls will be made available during normal office hours
and for purchase on request at anytime until Wednesday, 11 March 2009 (Election
Day).
Residential Electoral RollAll parliamentary electors are automatically enrolled on the local body
residential electoral roll at the address where they live. A confirmation card
was issued to all parliamentary electors during July and August 2008. Any
changes to the residential electoral roll (address details, etc) can be made by:
- completing the appropriate form, parliamentary elector's enrolment, at any
post shop; or
- by telephoning 0800 ENROLNOW (0800 367 656); or
- by accessing the Electoral Enrolment Centre website on
www.elections.org.nz.
Ratepayer Electoral RollIf a person is on the parliamentary electoral roll in one council area and pays
rates on a property in another council area, they may be eligible to be enrolled
on the non-resident ratepayer roll. People, who qualify in two or more different
community boards within the same city or district, may vote for the community
boards in all of those places; likewise people who qualify in two or more cities
or districts may vote for the council in those cities or districts. A firm,
company, corporation or society paying rates on a property, may nominate one of
its members or officers as a ratepayer elector (provided the nominated person
resides outside of the area). Likewise, where a property is owned and rates are
paid by two or more individuals, they may nominate one of their electors, who
must be a parliamentary elector not resident in the City, as a ratepayer
elector.

Voting PeriodVoting documents will be sent to all eligible electors by post from Monday, 16
February 2009
All completed voting documents need to be in the hands of the Electoral Officer
by 12 noon, Wednesday, 11 March 2009.
The voting period is three weeks until 12 noon, Wednesday, 11 March 2009.
Electors must post their completed voting papers using the pre-paid envelope,
which will be sent with the voting documents. A polling place for the issuing of
special voting papers and to receive completed voting papers, will be available
at the Electoral Office from Monday 16 February 2009 until noon on Wednesday, 11
March 2009.
Electors will also able to drop off their voting papers at Waitakere City
Libraries in the Massey Ward, during normal business hours until 12 noon on
Election Day, Wednesday, 11 March 2009.
Results will be released progressively as early as possible on Election Day and
published on this site. The preliminary result should be available on the
evening of Election Day.
