Council, its employees, contractors and agents ('Collectors') shall be entitled to access your property for the purpose of carrying out the Service.
The inorganic rubbish collection cycle runs over a period nominated by Council each year, currently from
mid March to June. The Service is not available at other times of the year.
The Service is available to selected residential properties only and each residential property may only request one collection in each collection cycle.
You must place items for collection in an accessible location within your property boundary.
The pile must be outside (e.g. not inside garages) and close to the entry point of the property, with a clear passage for trolley use. The pile must be easily identifiable as the pile to be collected. If your inorganic rubbish is behind a locked gate on the day of collection, our collector will not collect it.
Animals on the property must be restrained to allow unrestricted safe access. The Collectors have no obligation to enter any property where they reasonably consider any hazard or risk to be present.
The total volume of items for collection from any one property must not exceed 1 cubic metre.
The Service is for the collection of inorganic household refuse items of a type acceptable to Council from time to time. Council may from time to time publish a list of prohibited items which will be available on request. Items that are not acceptable for collection or that are considered to present a danger or risk to health or safety will be left behind, or the full collection rejected (at the Collector's discretion).
There is a charge of $23.00 (including GST) for the Service payable at the time of making a booking. Council may vary this charge from time to time. No cancellations or refunds are permitted.
Council will advise the expected collection date by email approximately two weeks in advance.
You are required to have the waste to be collected ready for collection by 7a.m.
on the day previously advised as booked for the collection. The Collector
will not return for collections that are not ready to be collected. However, the Collector reserves the right to change the collection date at any time.
The Collector will send an email, advising of the changed collection date or
will attempt to contact you by telephone to advise of any change. No
Collector will have any liability for any change in collection date.
You are advised to be at home when collections are made.
Once collected, title in all items pass to Council, provided risk in the items remains with you. Council may subsequently reject title in any items it discovers do not conform to then acceptable standards for collection. If rejected, you will be responsible for all costs of disposal of such items.
No warranty, representation or guarantee, express or implied, is given by any Collector in respect of the operation of the Service except as required by law.
To the extent permitted by law, no Collector will be liable to you or any other person for any damage, loss or cost which may be suffered or incurred from use of the Service, including (without limitation) indirect loss or consequential damage of any kind or damage to property or persons, and whether caused or contributed to by any Collector or third party (e.g. scavengers). However, if a Collector is held liable, its liability will be limited to a maximum sum of $100 (GST incl). This exclusion will not apply to damage caused directly by any intentional or reckless act or omission of such Collectors.
Council may vary any terms and conditions between us, or the manner in which the Service is provided, at any time. Council is not obliged to provide you with notice of any such change,
Any personal information collected by Council about you will be held in accordance with the Privacy Act 1993. Council holds information in its role as an agency. This information is required for lawful purposes used in the functioning of Auckland Council, and is sourced and held in accordance with Principle 2 and Part 7 of the Privacy Act. You have the right to access information about yourself and have it corrected (applications must be made in writing).
