A litter infringement is a fine issued for dumped or non-conforming refuse, including litter thrown from a vehicle, or escaping from a trailer.
How much is the infringement notice fee?
The infringement notice fee is $400. The Council can also prosecute under the
Litter Act 1979 for more serious offences and the maximum penalty upon
conviction is $30,000.
How do I dispute an infringement
notice?
If you wish to dispute the infringement notice refer to the "Summary Of Rights" on the reverse of the notice. You must put your dispute, or request for a court hearing, in writing to the Council.
When do I have to pay?
Payment of a fine is required within 28 days.
What happens if I don't pay?
If payment is not received within the first 28 days, a reminder notice will be sent giving another 28 days to make payment. If payment is not received the infringement will be enforced through the courts. Court charges will be added to the fine.
