Terms and Conditions for Online Payment of Rates
Introduction
These terms and conditions apply to the use of the online service for payment of
Waitakere City Council ("Council") property rates provided by EFTPOS New Zealand
Limited ("the rates payment service" or "service"). Please read these terms
and conditions carefully. You will be deemed to have accepted these terms and
conditions by authorising a payment of rates to be made through the service.
Council reserves the right to amend these terms and conditions at any time
without notice. You should therefore re-read the terms and conditions each time
that the rates payment service is used.
Key terms
The following is a summary of the key terms of the rates payment service:
The online facility is provided by EFTPOS New Zealand Limited which will charge you a convenience fee of 2.1% of the value of each transaction, with a minimum convenience fee of $3.00. The convenience fee will be separately billed to your credit card.
The Council does not receive any part of the convenience fee.
Payment may only be made with Visa or MasterCard credit cards.
Before using the rates payment service, enquiry should be made of the credit card provider as to the nature of the other fees (if any) payable to the provider as a result of using the rates payment service. For example, the use of a credit card issued outside New Zealand to make a payment using the service may give rise to liability to pay a currency conversion fee.
A payment completed through the rates payment service before 10pm on any
business day will be credited to the nominated rate account on the following business day. A payment made after 10pm
or on any weekend day will be credited to the nominated rate account after two business days. These rules do not however apply if the payment is subsequently refused or reversed by the credit card provider, for whatever reason. Council accepts no responsibility for refusal or reversal of payments which are matters solely between the user of the service and the credit card provider.
The credit card information supplied when using the rates payment service is retained by EFTPOS New Zealand Limited and is not supplied to the Council. The only information supplied to the Council is the name of the payer, the nominated rate account, part of the credit card number (first 4 and last 3 digits, for validation purposes) and the amount of the payment.
It is the sole responsibility of the user of the rates payment service to ensure that the information entered in the relevant fields within the online rates payment service is correct. It is recommended that you take and retain a copy of the transaction for record keeping purposes, and to assist with the resolution of any disputes that may arise from use of the service.
The rates payment service is provided through a secure website. However, neither EFTPOS New Zealand Limited nor the Council is able to give any assurance that information provided online by a user may not be able to be read or intercepted by a third party. The Council does not accept any liability in the event of the interception, "hacking" or other unauthorised access to information provided by a user of the rates payment service.
No warranty
No warranty, representation or guarantee, express or implied, are given by the Council in respect of the operation of the rates payment service.
Disclaimer and Limitation of liability
Council does not accept liability for any damage, loss, cost (including legal costs), expenses, indirect losses or consequential damage of any kind which may be suffered or incurred from the use of the rates payment service.
If however the Council is held to be liable, its liability will be limited to a maximum sum of $100 (GST inclusive).
The above disclaimer and limitation of liability operates only to the extent permitted by law.
These terms and conditions are governed by the laws of New Zealand and any dispute in relation to these terms and conditions will be submitted to the exclusive jurisdiction of the courts of New Zealand.
