What is a swimming pool? 

Any excavation, structure or product that has a depth of 400mm or more and is used for swimming, paddling, bathing or wading (including spa pools).

What is the Act?

The Fencing of Swimming Pools Act 1987 exists to protect young children from the dangers of unfenced swimming pools. It does this by requiring owners to fence their pools.

The Council's guidelines for the fencing of swimming pools have been replaced with the following:
"The Fencing of Swimming Pools Act 1987".

Can I be exempted from this Act?

You can apply to the Council for an exemption from the Act. The Council may only grant an exemption if it is satisfied that the circumstances will not significantly increase the danger to young children.

 

Does my pool require fencing?

All swimming and spa pools must be fenced, unless the minimum height of the sides of an out of ground pool is 1.2 metres and no climbing ledges exist. The fences must comply with the Fencing of Swimming Pools Act (1987) and the District Plan.

 

Does my existing pool have to be fenced?

Yes, all pools, no matter when they were installed, must comply with the Act.

 

Where must the fence be situated?

The fence must only surround the pool and the area immediately around the pool. This area can only include things used in association with the pool, for example, changing sheds. It should not include the clothesline or the vegetable garden; however, buildings may form part of the fencing if they comply with the Act.

Do pools require consent?

Yes, all swimming pools and spa pools require consent regardless of size and capacity. See our information on building consents
