Section 131 of the Building Act 2004 (the Act) requires all territorial
authorities (TAs) to adopt a policy on earthquake-prone, dangerous, and
insanitary buildings by 31 May 2006.
The policy sets out the Waitakere City Council’s approach in performing its
functions in relation to those buildings; the priorities to be observed in
performing those functions; and how the policy applies to heritage buildings.
This policy must be adopted in accordance with section 83 and 89 of the Local
Government Act 2002. Section 83 sets out the special consultative procedure,
particularly the requirement as to the preparation of a Statement of Proposal,
and section 89 sets out the requirements for a Summary of Information.
