By-Election New Lynn Community Board

Election Day was Friday 7 March 2008. Votes had to be returned by noon that day by post or at drop off points at Waitakere City Council or at designated libraries in the New Lynn Ward.

Summary

Kelly Schwalger submitted her resignation from the position of New Lynn Community Board Member, for personal reasons, to the Chief Executive Officer on Thursday, 29 November 2007. The Chief Executive Officer subsequently notified the Electoral Officer of the resignation on Monday, 3 December 2007.

Section 4 (2) of Schedule 7 of the Local Government Act 2002, provides that resignations take effect from the day they are delivered to the Chief Executive Officer, so Kelly Schwalger's resignation as a Member of the New Lynn Community Board was effective from Thursday, 29 November 2007.

Section 117 (1) of the Local Electoral Act 2001 prescribes that where a vacancy occurs in the office of an elected member of a community board more than 12 months before the next triennial local authority election, the vacancy must be filled by an election under that Act.

Nominations opened on Thursday, 20 December 2007 and closed at 12 noon Thursday, 17 January 2008. Nomination forms were available during this period from Council's Electoral Office.

Voting System for 2008

Council were offered the choice of two voting systems for the 2007 Triennial Elections. One system is the traditional First-Past-the-Post (FPP) system under which electors vote for one person per seat and the candidate with the most votes wins. The alternative is the Single Transferable Vote (STV) system, a complex system under which electors rank all the candidates, with their favourite at the top of their list and their least favourite at the bottom of the list.

On 31 August 2005, the Waitakere City Council resolved to stay with the First-Past-The-Post (FPP) electoral system. Residents were advised in a public notice of this decision and of their right to demand a poll to change the decision.

No demand from electors for a poll was received by the deadline and therefore, the Waitakere City Council used the First-Past-the-Post (FPP) system in the 2007 Triennial Elections. Accordingly First-Past-the-Post was the system used for the New Lynn Ward By-Election held on Friday, 7 March 2008.

Electoral Rolls

All residential electors and non-resident ratepayer electors whose names appear on the New Lynn electoral roll were eligible to vote in the By-election. The preliminary electoral roll were available for public inspection at the Council's Electoral Office, Waitakere City Libraries (in the New Lynn Ward) and NZ Post shops within the New Lynn Ward, from Thursday, 20 December 2007 to Thursday, 17 January 2008.

Copies of the roll were available for purchase at this time. Copies of the 2007 Master (marked) rolls were also available during normal office hours and for purchase on request at anytime until Friday, 7 March 2008 (Election Day).

Residential Electoral Roll

All parliamentary electors are automatically enrolled on the local body residential electoral roll at the address where they live. A confirmation card was issued to all parliamentary electors during July and August 2007. Any changes to the residential electoral roll (address details, etc) can be made by:

  • completing the appropriate form, parliamentary elector's enrolment, at any post shop; or
  • by telephoning 0800 ENROLNOW (0800 367 656); or
  • by accessing the Electoral Enrolment Centre website on www.elections.org.nz.
     

Ratepayer Electoral Roll

If a person is on the parliamentary electoral roll in one council area and pays rates on a property in another council area, they may be eligible to be enrolled on the non-resident ratepayer roll. People, who qualify in two or more different community boards within the same city or district, may vote for the community boards in all of those places; likewise people who qualify in two or more cities or districts may vote for the council in those cities or districts. A firm, company, corporation or society paying rates on a property, may nominate one of its members or officers as a ratepayer elector (provided the nominated person resides outside of the area). Likewise, where a property is owned and rates are paid by two or more individuals, they may nominate one of their electors, who must be a parliamentary elector not resident in the City, as a ratepayer elector.

Ratepayer Enrolment Form (Size 123K)
Use this form to apply for enrolment as a ratepayer elector and for every nomination for enrolment as a ratepayer elector.

Any changes to the ratepayer roll should be made at the Council's Electoral Office.

Voting Period

Voting documents were sent to all eligible electors in the New Lynn Ward by post from Thursday, 14 February 2008.

All completed voting documents needed to be in the hands of the Electoral Officer or Deputy Electoral Officer by 12 noon, Friday 7 March 2008.

The voting period was three weeks until 12 noon, Friday, 7 March 2008. Electors must have posted their completed voting papers using the pre-paid envelope, which was sent with the voting documents. A polling place for the issuing of special voting papers and to receive completed voting papers, was available at the Electoral Office from Thursday, 14 February 2008 until 12 noon on Friday, 7 March 2008.

Electors were also able to drop off their voting papers at Waitakere City Libraries in the New Lynn Ward, during normal hours until 12 noon on Election Day, Friday, 7 March 2008.

Progressive results were released as early as possible on Election Day and published on this site.
